INFORMATION PROVIDED PURSUANT TO ARTICLE 13 OF ITALIAN LEGISLATIVE DECREE 196/2003 CONCERNING PERSONAL DATA PROTECTION
THE PURPOSE OF THE INFORMATION
This section aims to describe the operating methods of the site as regards processing the personal data of visitors to the site. These data shall be processed according to the principles of legitimacy, correctness, relevance and non-redundancy- This information is also provided, in accordance with Art. 13 of Italian Legislative Decree 196/2003 - Personal Data Protection Act, to users of the web services of Motion S.r.l., accessible on the Internet. The information is only provided for the site www.motionitalia.com and not for other Web sites the user may visit by clicking on links. The information is inspired by Recommendation No. 2/2001, which European personal data protection authorities, gathered in the group formed by Art. 29 of Directive 95/46/EC (Download), adopted on 17 May 2001 to identify some minimum requirements for on-line collection of person information, specifically, the methods, timing and nature of the information the data holder must provide visitors when the latter click on links to Web pages, regardless of the purposes of the visit.
After visiting this site, data related to identified or identifiable persons may be processed. The data holder is Motion SpA, with offices at Via Biondini, 27 – 47121 Forlì (FC), Italy.
PLACE OF DATA PROCESSING
The processing connected to the Web services of this site takes place at said address of Motion SpA, and is only carried out by technical personnel working in the department assigned to processing, or anyone charged with occasional maintenance tasks. Data shall be processed based on their storage in computer files at the company, with access to data limited to maintenance procedures. No data obtained by the Web service shall be communicated or diffused. The personal details provided by visitors requesting a service shall only be used to perform the requested service and not disclosed to third parties, unless this is required by law or is strictly necessary for satisfying requests.
TYPES OF DATA PROCESSED
Browsing data. During normal operation computer systems and software procedures that keep this Web site working collect some personal details (such as log files) whose transmission is implied in using Internet communication protocols. This information is not collected to be associated with identified data subjects, but given its nature it could enable identification of visitors after processing and association with data in the possession of third parties. These data are utilised solely for gathering anonymous statistical information on use of the site and for ensuring that it is working properly. The data may be used for verifying responsibility if any computer crime is committed on the site and may be shown to judicial authorities if specifically required. Data submitted voluntarily by the visitor. Explicit and voluntary sending of electronic mail messages to the addresses shown on this site and the completed registration form will lead to collection of the personal details entered. Specific summarised information shall be progressively reported or displayed on pages of the site created for users to request particular services.
No personal details are collected on visitors by the site in this regard. Cookies are not used for sending personal information and no tracking or visitor identification systems are used. Cookies are used solely for sending session IDs (consisting of random numbers generated by the server) necessary for enabling the visitor to browse the site safely and efficiently and are used only for statistical purposes for counting individual visitors per month. The cookie can be deleted by the visitor by using browser functions.
OPTIONAL NATURE OF GIVING YOUR DATA
Apart from what is specified regarding browsing data, the visitor is free to give his or her personal details on the request form submitted to Motion SpA or whenever our office is contacted to request materials or other announcements. Refusing to give your personal data could make it impossible for you to obtain the requested service or item. For the sake of completeness, please note that in some cases (not subject to ordinary operation of this site) the authorities may request us to submit information pursuant to Art. 157 of Italian Legislative Decree No. 196/2003, for the purpose of control of personal data processing. In these cases providing data is mandatory and any refusal may lead to a sanction.
Personal data are processed using automated means for the time strictly necessary for achieving the purpose for which they were collected. Specific security measures are taken to prevent loss of data, unlawful or improper use and unauthorised access.
RIGHTS OF DATA SUBJECTS
The subjects of the personal data have the right at all times to obtain confirmation as to the existence of said data and to know the content and source, check their accuracy, ask for them to be supplemented, updated and corrected (Art. 7 of Italian Legislative Decree No. 196/2003). Pursuant to the same article, data subjects have the right to ask for deletion, transformation into anonymous form or blocking of data processed against the law, and to object to processing due to justified reasons.
